Normal police interviews are recorded on audio tape. Terrorism interviews are recorded on DVD.  Normal police fingerprinting takes 5 minutes and is done digitally, the best machine I've used was the Motorola used by the Canadians, the others fail far more often.  To be honest most of them almost all the time, this is no excuse for when one tall, blonde, fortysomething policeman started hitting the machine in Heathrow police station.  The machine beeped, he hit it and hit it, we continued fingerprinting, the machine beeped again, he hit it again, like a very sturdy TV set with no will to please, this did continue, "Do you wanna take five?" I proposed the suggestion. So he took his fit and walked it off in the corridor. The room had a poster, I had more freedom to look around being the only one in the room now, it read "The password is PASSWORD." After he had battled with his conscience enough he managed to bypass the machine's security checks, it moved on, and so did we, back to the group by the front desk. "If that machine were human, I'd have kicked it's head in." This quietly appalled me, later I pondered and still do how this sounded to the others present, I'd later learned that a border officer present had left the business, maybe to become a pig farmer or walk the earth like Kane in Kung Fu, the moment was broken when the border officer instructed me to sit back down on a hard bench. A counter terrorism (CT) sergeant later told me that the DNA samples that a different cop had taken during the same evening hadn't been readable at all. He explained and proceeded to swab 20 times, if memory serves me here, twice, getting two swabs of samples of my DNA, my code, my program, to take away to their lab to hash. A hash is a small bit of data used to precisely identify a large bit of data. So they don't, so they say (smile), have my DNA on file, they can't now analyze me with their shiny new algorithm to work out how likely I am to develop a crush on a wild animal, nor even to clone me, of course the latter being illegal under UN law. Yet they can now tell if I had a wet dream (still waiting) on a hotel bed in مراكش, or used a razor thrown in a trash can in a suite at the Los Angeles Ritz-Carlton, lovely views of the Pacific 'cept your helicopter has to land next door as they can't open the roof door or some other story.  Terrorism (TACT) fingerprinting takes 2 hours.  It is in ink.  It includes "bunny ears", Writers Palms (the sides of the hands) and footprints.

When one receives a criminal sentence, when processed after some days, a printed and stamped document arrives giving the details in black & white. It states precisely how long they will imprison you, how long they have kept you prisoner, et cetera. Look out for the HDC section. HDC is excellent. With it you get released 50% sooner than without it. If you funk with them, they can add a small Skipped Bail charge which if convicted appears as if it costs you a week or two extra in prison, this is a whitewash, it'll take your HDC, and in doing so adds 50% longer to your sentence. The answer is to not skip bail. Unless you can stay hidden. Best place, obviously, is in a different global state. Most people have ties and don't like to move like this. They can and will, quickly, gain access to and use external data to track you, including mobile phone records and bank statements. One solution is to pay cash. That simple. Hotels also like a card, like a Visa, even if they take the cash, just in case. So get one in a false name. This is a piece of cake. Only the main account holder's details are validated, any additional card holder's aren't cared for. So Genghis Khan might not be the best choice but John Henderson probably'd be sweet. Think blend in. John 'Lofty' Wiseman said similar, if you don't want to stand out then instead blend in. Move in the same direction, talk in the same type of voice, use the same words, wear the same clothes. The clothes make the man.

Posted online 02 Jun 10.  The IPCC is a non-police UK government body that helps with public complaints to the police's internal complaints dept., the DPS, the Directorate of Professional Standards.  We complained to the IPCC around July of 2009, the IPCC forwarded the complaint to the relevant DPS for the area, London, and the DPS tried to give us timescales that we couldn't adhere to being, as we were at the time, incarcerated in a PICU, Psychiatric Intensive Care Unit, without access to any funds, see explanation elsewhere, and only some limited phone calls provided by the hospital.  Actually the hospital helped, they respect the police.  So the complaint was then lodged with the police.  On 09 December 09, a DS (Detective Sergeant) with the DPS came to interview us, now in an 'open ward' hospital, with her colleague, also female.  They made a short, surreal sketch show playing with their 'Hello Kitty' pencil case.  Pencil cases are straight out of school in my mind.  And 'Hello Kitty', apart from the oddity of the phrase, it was the brand appreciated by the kid in the film, (Dark Water), watched in prison, aged ~10 not ~30.  We appreciate when we occasionally make the space to watch a film that's novel to us.  It's a sign that things aren't too bad; that the film is good proves that not everything is rotten with reality.  It's ultra 'canned' (some even go to Cannes), shiny (even when dark) and <more thought due />, but fiction is good (Mr. Mackey sounding in our head), imagination and dreams are very good.  Our mind fogs now, we're still stuck here, bangs are frequent, now music from a car in the street, the bass, it's rare, normally it's just traffic noise and the attacked traffic noise; a very large motor gone insane with a life of its own.

Dated 28 Apr 10.  We miss our assembler, our copy of Borland assembler.  It's a $150, old, yet extremely useful, low-level programming tool.  With it one builds small, fast programs that run on the one computer type.  When we say small and fast we mean the smallest and fastest.  Recall ordering it in Hollywood, a nice hotel with a great view over LA, not really photographic but the view took us in as an LA virgin, the Chamberlain West Hollywood, two minutes I reckon (didn't venture out at night in LA, heard one too many rap song mixed with self-confessed stories of (Madonna's ex...) Sean Penn, fighting hardily) (NB Madonna's always kool we remember whilst inserting the hyperlinks) from the Viper Room club where River Phoenix died from partying.  Go Gen X.  But we digress.

RIPA (Regulation of Investigatory Powers Act 2000) part III (which came into force in October 2007) section 49 Notice.  We weren't the first, undoubtedly not the last... our aims (saying aims makes us seem like a terrorist cell, put on Hans Gruber accent..., can you say beercan without sounding like a Jamaican saying bacon?) include breaking this law.  Is it possible?  Maybe.  It's unjust, it's backward, the US (Earth's #1) wouldn't stand for it, and they have the paperwork to prove it (Amendment V, "No person shall be ... compelled in any criminal case to be a witness against himself").  As you can see, failure to comply is a crime under section 53 of the act (a law).

Foreword

The spirit of this text is chaotic yet within order.  As the rain.  We hope it will inspire anarchy and civilization will fall simultaneously we hope that it doesn't, that control will prevail.  Duality; 1 and 0, yin and yang, the range of a sine wave.

The following is a first hand view of a true story.  If it'd help you, we do swear that this is the truthful account of our perceptual experience; our life.

And it's for you, the reader.  Also in the spirit of honesty also for us; this is therapeutic.

Our society, for sometimes we belong with our birthright, is an Emperor's New Clothes analog.  We cannot shout too loud, it's a huge buffer solution, no damage will be done.  Our aim is not to burst your bubble nor rock your boat (not too much).

It's not difficult to discover our identity, our business and even to attempt to find out where we're living now.  We're not trying to encourage but we do not want publicity and so there's no point self-publicizing.

The Start

Our name is JFL, me, myself and I.  Anonymous us.  We are a computer scientist.  We have a small software business in Silicon Valley, that's the valley area around/of greater San Francisco in the State of California, USA.

We've manufactured and self-published some small software programs.  We've received reviews by the editors of CBS C|Net Download.com.  We've been published in international computing mags and our shareware software has been given away on magazine coverdisks.  If we had yet made our $millions we would have had far more leverage with which to avoid this.

Our life as a quest for enlightenment and instant realization of our dreams has been ... a long and different story.  This here is solely the true story of these obtuse events spanning the past three years.

We start at the beginning.  Twas early in the 21st century, a long awaited time, since a childhood occasionally watching Space 1999 , 2001 and 2010 (not all that) and reading 2000AD.  Things were not idyllic, twas 2007, around April.

Things were not idyllic.  The business was getting off to a good start but was basically penniless.  Grants weren't possible, loans weren't possible, some friends & family had bought in but this allowed groceries and not $10k advertizing campaigns.  One of these was our Godfather, a doctorate research scientist for a large, multinational computing corporation.  We were auto-running off emails in their tens and more to ~seed financing companies in search of funding.  One or two faint interests were shown and that was all.  (They all want niches and are not looking for solidity within a boom market).  The rent that should have been covered by Welfare wasn't, and instead was due.  An eviction notice had been given and try as we might, it didn't like to be ignored.

Then we received an odd email or three.  From our distanced parents. They wanted to talk.  It turned out that our Godfather had died and bequeathed to our good selves $½m.  Things had changed.  The imperative to leave London hit us; me, myself and I.  We packed, said goodbye to the home comforts and caught a plane to Geneve (Suisse).  In the hand luggage was data media; a hard drive.  In hand was a suitcase literally full of top secret R&D docs to be shredded.  Arriving at a small mountain retreat that had been discovered some years previously, at the end of a train line, a train line that crawled up a mountain, ending at around 1,000m in a quiet place.

Unbreakable Encryption

A five hour drive to the border.
It was a dark Friday night, and we'd also overstayed a week at the apartment.  We made the border in around five – six hours.  Stopping outside Syracuse for a break.
"Is that an armored vest you're wearing?",
"It is."
"Do you have any weapons in that bag?"
"[The pepper spray, the tear gas within the same small spray can, the utility knife used to pack earlier that day.  What to say?]  No."
"Would you step out of the car, I'm gonna search you... Stand with your legs apart.  [Young, male, tall, blonde Canadian border officer grabs our hands and pats us down.]  I'm not arresting you."
"[For what we think?]... OK."

...

"Open the [your] laptop."
Done.
"[Password:_]"
"Unlock your laptop."
"It's a business computer, I'm not inclined to decrypt it without reason."
...
"I'm arresting you for impeding a customs search.  Follow me [to the local cell]."
Again imprisonment.  This is twice now in 32years, not overly heaps on the general scale yet once per quarter is pushing acceptability.  This one for six hours.
"OK, I'll unlock them,"  Our guess is they'll not find the hi-sec data or else we'll cross that bridge, no pun intended, when we get to it.
"If you don't mind waiting."
"[Eh?]"
Kerry, the visually attractive Canadian Intelligence officer arrives and interview us; female, blonde, thirtysomething.
"Blah... blah... Why did you change your name?"
"For many reasons...," we retorted, not the later choice, 'because we preferred it.'

It's 7AM and the Immigration officer arrives.  "You must go [back] to Buffalo to speak with the embassy."  Translated to 'Die.'  He wanted to kill us.  Maybe he did.  As Aldous Huxley wrote in the Doors of Perception, "Would you be able," my wife asked, " to fix your attention on what The Tibetan Book of the Dead calls the Clear Light?"

The US ICE station (not Zebra) on the bridge imprisoned us; thrice now we're counting.
"Do you have permission from the U.S. Government to be in the U.S. at this time?"
"No.[?]"  'I'm an alien, I'm an illegal alien, I'm an Englishman in New York...'

"You're going into custody...  Should fly home in a few days," the arresting officer said.

Imprisoned, incident #4.  BFDF, Buffalo Federal Detention Facility located in Battavia.  It's in pretty countryside.  And contains 98% Mexicans, 2% others like ourselves, where the other wings contain hardened criminals like the Yardie gangsters, murdering drug dealers.  Imagine there's no possessions, it ain't easy, just try.  Forest Gump giving inspiration to John Lennon.

Three very, very long weeks later.  To the armed ICE agent in the next seat escorting us to our connecting flight from Washington Dulles, "That's Lake Erie [down below], yeah?"  He confirmed.  It looked pretty, and very large.  Canada on one side, USA the other, how many radar stations monitoring wooden (?) row boats full of international criminals smuggling themselves could there be?

Big Guns

[Bang].  Uh.  [Bang].  [Bang].  Neighbors?  [Bang][Bang][Bang].  Oh shit.  This is a robbery.  They want the computers.  Phone.  Now.  Police.  Wrong button.  Again.  Police.  "Police...  Flat 47..."

"JFL we know you're in there..."  This is a polite and well researched robbery.  Or is it?  "I'm naked."

Guns.  Big guns.  Standard issue Heckler & Koch MP5-N or similar submachine guns, tens of live bullets, in the clips and in the chambers.  In our small bedsit/studio, pointing at us.  OK, hands are up.  Here they are.  We are a good simian.

'Bust a move, reach for clothing, just like in Colors by Dennis Hopper,' we desist.

They didn't kill us.  Probably.

An Extreme Curse and a $½m Inheritance:

I have been a part of a very peculiar experience over the past three years.  I am a 34yo computer scientist with my own small business in Silicon Valley.  I had never even been questioned by police, though had probably broken a law or two years ago.  I had never been sectioned although had minor mental health treatment a decade ago.  Three years ago I was informed that my Godfather dying unexpectedly in his 60s had bequeathed me $½m.  I left London where I had been born and had lived most of my life, for the European mainland countryside.

I have been brutalized by my experiences; spent most of a year imprisoned inc months with 23hr lock-in within a Victorian ghosthouse, been sectioned under the Mental Health Act, felt the most extreme agony to date, had my life threatened with guns to mention one incident, lost all the money and almost all of my possessions.

The link to the number thirteen (13) is ever present.  These are some of the facts, it will undoubtedly seem ridiculous and untrue whereby I offer proofs for your scrutiny.

It started slowly and increased.  Imprisonment in CH for 1hr, then CA for 6hrs, then US for ~25days, then the UK started hitting.

Arrested 07 Mar 2009, week 10.
Crown Court 02 Jun 2009, week 23, 13wks later.
Leaving for Court from cell number 1-3 of a block of 13cells.
Sentenced for 13 (victimless, civil disobedience) crimes to 13months imprisonment.
Due for release; CRD Conditional Release Date with ECL End of Custody License, 02 Sep 2009, week 36, 13wks later.
Found an apartment week 49, 13wks later, lease started the next day 07 Dec 2009.
Probation ends, early due to prison error, 04 Mar 2010, 13wks later. 
Probation license expires the next day 08 Mar 2010.

My thoughts are that an extreme hallucination may have been survived.

I am recovering well from my imprisonment and this episode appears to be gradually lifting from my life.  I now reside a few kilometers from where it started three years ago, looking again to leave London ASAP.

Rosa Parks, bien sur.  We were also moved by the two Save Ferris offers, from Philip Hands a forum poster on the Register and Mark of Spy Blog.  Both came too late, due to our late publicity, to be of use yet had we been imprisoned for longer we could have appreciated them far more.

Here is a copy of the email we sent in response to Eduardo Gill-Pedro, Advice and Information Officer at Liberty, the UK human rights charity:

Dear Mr. Gill-Pedro,

Thank you very much for your email.

This communique is to continue to discuss this legal point/case.

I am a highly skilled and experienced computer scientist and have run my own computing development small business for thirteen years, firstly in the UK and now in the US.

Proportionality. My case, and maybe the whole of RIPA part III, is extremely disproportionate. My sentence is extremely disproportionate, of nine (9) months of a two year maximum, after my guilty pleas giving it a 16month maximum, where, at the day of the Court appearance no benefit would have been achieved by the UK as the police had dropped their case over a month previously. Police were not at that stage interested anymore in the contents of the allegedly encrypted data, yet the Judge noted that I had not to this day given access, probably unaware of the lack of police interest.

On 2010-03-03 17:11, Eduardo Gill-Pedro wrote:
This finding of the court has been doubted by Roberts, amongst others, who contends that an encryption key “is an intangible “psychological fact”, that is to say, it is information which exists only in the suspect's memory and that of any other person who might “know” it.” (Andrew J. Roberts - Criminal Law Review 2009, 3, 191-193). However, since the key is also remembered by the computer, and could presumably be found by sufficient de-coding devices, it would be difficult to sustain this argument.
Actually it isn't an encryption key, especially in my case of purportedly using PGP Corp encryption software, instead it is a part of an encryption key. A key for this type of system consists of part 1: the bulk of the key and part 2: the far smaller human remembered part, generally called the passphrase and is not written down anywhere. The complete key is not remembered by the computer, it doesn't need to do this and it would compromise the security of the system if it did.

"Sufficient de-coding" devices to brute force decrypt any suspected data could not discover the complete key. The sole indication that there ever was any part of any key or indeed that there ever was any encrypted data is the random incomprehensible 'data' on the data media together with the identifier markings of the well known encryption software.

“does not extend to the use in criminal proceedings of material which may be obtained from the accused through the use of compulsory powers but which has an existence independent of the will of the suspect such as, inter alia, documents acquired pursuant to a warrant, breath, blood and urine samples and bodily tissue for the purpose of DNA testing.” (at para. 69)
It does not exist independently. The private, personal knowledge is definitively solely known in the mental space of the encryptor, i.e. myself. It cannot, under current technology i.e. without some future brain probe, be extracted as can today breath, blood, urine and bodily tissue.

and held that the privilege was open to qualification where the question was directed to a serious social problem
I draw your attention again to the facts that:
1) The case was never based on any substantial evidence, only circumstantial based on a selection of my possessions when looking at everything that I was moving as I was moving my home, plus 9ng (nine billionths of a gram) of high explosive found on one of my hands, none on the other and none under my fingernails nor on any of my clothing. This is a minuscule amount described by DSTL (the UK Government's Defense Science and Technology Lab) as "consistent with, for example, contact with an item or items contaminated with this explosive." Not contact with any explosives. It came from somewhere, I had travelled that day in multiple public access areas inc taxis, trains and hotels, and notably they didn't test the handcuffs that they used on me. For example, if someone in the military would had handled C4 and had 100ug (100,000ng, one hundred millionths of one gram) on his glove touched the foreign exchange counter and gave it half, 50,000ng then I had the next day touched it and received only 1/10 of 1% then I would have had five times more than actually detected,
2) The case was dropped by CTC Police one month prior to the Crown Court hearing.

The scary word Terrorism, as it isn't relevant isn't a valid context. It isn't relevant as there never was any valid evidence of terrorism. They were simply scaremongering, as they were when they suggested that I would be suspect of importing child pornography if I didn't comply with their requests, and mentioned this slanderously in every court.

However, one noteworthy point was that the court in Brown was influenced by the fact that “the penalty for declining to answer under the section is moderate and non-custodial”, which could be contrasted with a penalty of conviction on indictment and imprisonment for a term not exceeding two years, contained in s. 53(5) of RIPA. While this could be a potential avenue for appeal, it is unlikely to succeed, given that the Court of Appeal has held that the encryption key has an ‘independent existence’ and that the privilege is therefore not engaged.
Yet it does not have an "independent existence", see above, and so this is overruled and again your point is valid. I agree that the 9 of 16months sounds to me very disproportionate, especially without any evidence. They also tried many avenues to ensure jail time, including nine charges of RIPA s53 from the one incident and adding two false, malicious charges of telling the Passport Office that my passport was lost when they felt that it wasn't yet had informed me, the DC has now lied about this to the DPS, that I'd never get it back, and they have actually taken steps to ensure that I will now never get it back.

500 comments and 1.3k votes show this case has reached a wider audience, with only the one starting link in the right place.  (So who knows... if we can successfully get the conviction overturned it'd be useful, better than not...)
